CBP Delays ACE Implementation

As predicted, CBP has delayed the mandate for ACE from November 1, 2015 to February 28, 2016. We also are predicting that this date is firm and will not be moved again.If you have not yet initiated the transition to ACE, you need to do so immediately to ensure that they are ready well in advance of the February 28, 2016 deadline.

November 1, 2015
This now starts a transition period to migrate to ACE. All filers are encouraged to file in ACE for entry types 01,11,03,51 and 52. At this time, FDA, NHTSA and Lacey Act should be available for most participants.

February 28, 2016
On this date, filers will ONLY be permitted to file in ACE and no longer allowed to file in ACS. All electronic entries and related entry summaries for the entry types 01,11,03,51 and 52 MUST be filed in ACE including FDA, NHTSA and APHIS Lacey Act.

This date also starts the next transition of the remainder of entry types an the rest of the PGA interface.

This is clearly the right move as CBP is not ready for the PGA changeover. PGA pilot testing began on August 19 and it has been a slow and arduous process for all involved. Changes are still being made to the integration guidelines and some of the programming documents are still in draft format.

GMS has been on countless conference calls and meetings with ALL Participating Government Agencies to better understand their guidelines. We are at the forefront of ACE and highly regarded by CBP. We were on schedule to meet the deadline and have completed the programming for ALL PGA's except APHIS Non-Lacey, which is next on the list. When the September ITEC Update is released, you will have access to the following PGA programming;
  • FDA w/Prior Notice
  • EPA Pesticides
  • EPA Vehicles & Engines
  • EPA Ozone Depleting Substances
  • AMS Marketing Orders
  • AMS Egg Inspections
  • APHIS Lacey Act
  • ATF
  • DDTC
  • NMFS Tuna Tracking
  • NMFS Highly Migratory Species
  • NMFS Antarctic Marine Living Resources
  • TTB
  • FSIS
Although you will have access to these programs, you cannot submit PGA data to CBP at this time unless you are on the approved pilot list. For more information on pilot testing and eligibility, please review thepilotroll-outplan at
Effective July 29, 2015, filers again are entitled to file GSP- eligible entry summaries without the payment of estimated duties.

This eligibility is retroactive from July 31, 2013. Any ABI entry summary that was filed with payment of estimated duties using the Special Program Indicator (SPI) for GSP ("A"), require no further action by the filer. These filings will be treated as requests for refunds.

If an ABI entry summary was filed with payment of estimated duties without the use of the SPI "A," a refund of duties deposited must be requested in writing.

GSP provides retroactive benefits only to goods from a country that is a beneficiary of the program as of July 29, 2015. As such, this would exclude countries such as Bangladesh and Russia that lost eligibility between July 31, 2013 and July 29, 2015.
